Business Terms and Conditions
We pride ourselves in providing the highest possible levels of customer service. To ensure that the supply and installation of your order progresses as smoothly as possible we need you to understand the key points of our working relationship. We always strive to be fair and straightforward but we do need to clearly define the scope of our work and set out the responsibilities of both parties in order to avoid any misunderstandings. We have therefore prepared this simple document with clearly defined headings which we call our Business Terms and Conditions. We hope that you find them helpful in that they clarify our position and explain the way forward in any situation that we are likely to encounter.
Definitions
Company means Valcucine London limited, always referred to as simply Valcucine London. The Contract means the agreement between Valcucine London and the customer to which these Terms and Conditions apply. The Goods mean the products, equipment and services which are to be supplied under the Contract. The Customer is the party in whose name the order is placed and whose name appears on the order documentation.
Pricing policy
All prices inserted in our Contracts are net and Value Added Tax is added as appropriate in accordance with current government legislation. All relevant discounts and special offers will have been taken into account in preparing our prices. In the event of an unavoidable increase in the rates we pay to our suppliers, we reserve the right to increase our own rates on a pro rata basis.
Your Quotation
The prices of the products to be supplied, any delivery and installation costs plus the proposed Terms of Payment will be clearly shown on your quotation. If you require any changes please ensure that you ask for a revised quotation. When you accept our final quotation you can then be sure that the items to be supplied and the work to be done is correctly defined in the Contract documents and clearly shown on the drawings.
Disclosure
All technical data, drawings, reports and any other information or documents which Valcucine London have submitted to a customer during the preparation of a Contract remain the property and copyright of Valcucine London and may not be disclosed or copied to any third party. All original documentation is to be returned to Valcucine London on demand.
Order instructions
All orders and any subsequent instructions should be confirmed in writing to us at the earliest possible opportunity. Valcucine London is unable to accept any responsibility for variations or omissions arising from non-conformity with order documentation. Where an instruction is given by an architect, designer or other person on behalf of the end customer, then such a person is deemed for all purposes to contract with Valcucine London jointly and severally with the customer.
The Goods to be supplied
We make every effort to ensure that the goods we supply conform to the specifications we have agreed with you. Continual improvements in materials, product design and methods of manufacture mean that we reserve the right to change specifications without prior notice, but such changes will not materially affect the appearance or performance of the goods or installation. If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you, and with your agreement we will replace it with an alternative of equal standard and value.
Brochures and computer generated images
The quality of printed and computer generated images allow for accurate representation of colours and finishes, but these images should not be relied on for the selection of final finishes. Wherever possible, Valcucine London will provide material samples or colour charts for the selection and matching of final finishes.
Accessories
It is the general policy of Valcucine London to include in their design presentations a wide range of additional furniture and accessories to illustrate both the function and aesthetic qualities of their proposals. Accessories are also added to indicate that a wider range of product may be available for selection. The use of these graphic aids does not confirm the inclusion of such elements within any offer unless specifically described in a Valcucine London quotation.
Terms of payment
Payment terms will be as set out on our quotation as part of the contract. It is important that the terms are complied with in all respects as any delay will result in the automatic delay in the delivery and or installation of your order. The installation needs to be reschedule in relationship of the availability of the fitters. Please note the fitter must have at least 1 week of notice, otherwise a charge will be applied according to the fitter.
Responsibility for Goods
The risk of damage to or loss of the Goods will pass to the Customer when the goods are delivered, deemed to have been delivered or accepted by the Customer as being practically complete. This responsibility will normally pass to the Customer on signature of a delivery note or when Practical completion of the installation is achieved.
Preparations for deliveries
It is the responsibility of the customer to remove and dispose of any existing items which are to be replaced by the goods included in the Contract. We do not accept any responsibility for any costs, direct or indirect, or for any inconvenience caused to customers who are left without amenities due to the removal of existing facilities
Site conditions
An adequate access point, driveway and hard standing is to be provided by the customer for the Valcucine London delivery vehicle up to a hoisting position or ground level point of entry to the building. In addition, all walls, floors and ceilings within the building are to be provided in a suitable condition and protected where necessary to receive the goods. Valcucine London reserves the right to delay delivery or the performance of their Contract without incurring any liability for delay until such time as the whole site is deemed
acceptable.
Site storage
The customer is responsible for providing an adequate secure storage space immediately adjacent or as part of the working area in a safe and dry location. Storage and installation areas are to be maintained at a temperature of 12 degrees Celsius or above.
Temporary services
Temporary lighting, power, water and all other necessary attendances are to be provided free of charge by the customer. Parking for one vehicle to be provided by the customer for each day we are working on site.
Storage charges
Where despatch or collection of any goods is delayed at the customer’s request or where the site is not ready or in a suitable condition to receive the goods, then Valcucine London shall have the right to store the goods at the customers expense and to invoice storage charges calculated on the basis of £30.00 per cubic metre per week from the date originally agreed for delivery.
Part deliveries
Valcucine London reserves the right to make a delivery surcharge on part order deliveries requested by the Customer which were not specifically identified at the date of order. Instructions to Valcucine London employees on site
Valcucine London employees and subcontractors on site are not authorized to accept instructions from the Customer or the Customer’s agent on site. All instructions should be directed to Valcucine London’s project manager and confirmed in writing to us as soon as possible.
Installation service
Our installation service is limited to just a dry fit installation. This includes the assembly and installation of the kitchen furniture, worktops, sink, taps, appliances and any kitchen lighting fixtures, with the final electrical and plumbing connections to the services and any other additional work, such as ducting, to be carried out by the main contractor.
Worktops
On the kitchen worktop there is always the possibility of a joints, depending on the dimensions, the material, colour or collection of the slab. Our worktop drawings are a suggestions that need to be approved by the fabricator on site during their templating, this is because they will be responsible of the installation and the durability of the product and they might add brackets, extra support or any other suggestion that make the worktop safer and durable in the time. They might ask also for solid carcass top, if this will be the case we will provide this.
Materials features and tolerance
Due of the nature and the making of some materials, like natural stone, glass and metals, you must consider a tolerance on the sizes and colours. We cannot be responsible for any colours or size discrepancies or material imperfection because this is due to the nature of the material. All the material features supplied from Valcucine can be founded on our book of finishes and cleanings guidelines.
